GENERAL TERMS AND CONDITIONS
A. GENERAL
Viva la Villa is an agency that mediates between the owner of accommodation
and the tenant.
These terms and conditions apply if you use the services of Viva
la Villa.
You are responsible for the transport to and from the accommodation.
The accommodation offered by Viva la Villa is based on a good
price/quality ratio.
Viva la Villa makes use of a star system to rate the accommodation
in terms of quality and comfort.

Viva la Villa seeks to keep the descriptions and photographs of
the accommodation up to date, but is not always informed of small
changes made to or in the accommodation and we therefore cannot
be held responsible for interim changes.
The description of the accommodation will state if satellite television
is mentioned, this does not guarantee that you will be able to
receive every channel you receive at home.
Where the accommodation has a garden and/or swimming pool you may
expect a visit from a gardener or pool boy to perform the necessary
maintenance activities.
Towels and bed linen are available in the accommodation, however
you are not supposed to use them on the beach. We therefore advise
you to bring some (bath) towels.
As regards additional facilities, such as an extra bed, a child’s
bed or cleaning, please contact Viva la Villa first about the possibilities.
As not all accommodation is suitable for people who have difficulty
walking or with small children, it is useful to ask Viva la Villa
about this, where necessary.
The tap water in Spain is of a different quality than we are accustomed
to in the Netherlands and generally one should refrain from drinking
it. In the early and late season you may expect restricted opening
hours of shops, bars and the like and more limited facilities and
connections.
B. BOOKINGS
Holiday accommodation may be booked by sending us the completing
booking form after which the booking is binding.
You may first enquire about the availability of the accommodation
via email or via our information number.
Your reservation is binding for Viva la Villa after sending the
booking confirmation and the invoice.
C. PAYMENTS
The rent is listed in euros per accommodation and per week (winter
accommodation per month).
The payment and annulment terms and conditions listed below apply
to the accommodation to be booked.
A down payment of 25% of the total sum owed must be paid into the
Viva la Villa bank account within two weeks of the date on the
booking confirmation.
The remainder must be paid into the Viva la Villa account within
eight weeks before the commencement of the rent period.
In the event of reservations the full travel sum must be paid directly
by a transfer by telephone into the Viva la Villa bank account
or by a cash payment to a representative of Viva la Villa against
receipt of proof of payment within two weeks prior to the commencement
of the rent period of the accommodation.
Where payment is not received in time, Viva la Villa reserves the
right to regard the booking as annulled.
D. ANNULMENT
Any annulment of a booking made and accepted by us must be communicated
to us in writing and will be confirmed by us in writing.
100% of the travel sum is charged in the event of annulments within
two weeks, 50% in the event of annulments between four and two
weeks and 25% of the travel sum in the event of annulments up to
four weeks prior to the date of departure.
Administration fees are not refunded upon annulment.
These terms of annulment also apply in the event of non-payment.
We advise you to take out a travel and annulment insurance.
E. DEPOSIT
You must pay a deposit for most accommodations upon arrival.
The payment and refund of the full or partial deposit is a matter
between the supervisor and the tenant.
Viva la Villa is prepared to mediate but may not be held liable
for any problems ensuing there from.
Where you have not caused any damage the full deposit will be refunded
to you after a survey by means of a refund into your bank account
or a cash refund immediately upon leaving the accommodation, the
latter only where an immediate inspection of the accommodation
is possible.
Where it becomes clear that more time must be spent on the final
cleaning round, e.g. because dirt, filth is left behind or the
dishes have not been done, the additional cleaning expenses will
be deducted from the deposit at 12 euros per hour.
Any damage will be deducted from the deposit, you continue to be
liable where the costs of the damage exceed the deposit amount.
F. LIABILITY VIVA LA VILLA
Where Viva la Villa must annul the booking due to unforeseen circumstances,
the client will be offered accommodation that is as similar as
possible.
Where this is not possible or the client does not accept the accommodation
that is as similar as possible, Viva la Villa will return the paid
rent and the booking will be regarded as dissolved without any
damages for whatever reason.
Viva la Villa does not accept any liability for damages and/or
personal injury and/or any other harm of whatever nature.
Viva la Villa does not accept any liability for changed circumstances
in or close to the rented accommodations, such as, for example,
building activities.
Viva la Villa does not accept any liability or claims for damages
of whatever nature in the event of disruptions relating to electricity,
gas and water supply.
Errors and/or mistakes do not bind Viva la Villa.
G. LIABILITY CLIENT
The client is responsible for any damage to and in the accommodation
during the rent period.
Where the accommodation is used by more persons than listed by
the client upon the booking, Viva la Villa may require additional
payment or dissolve the tenancy agreement without any obligation
to pay any right to damages for whatever reason.
Upon losing one or more key(s) of the accommodation, the client
must pay a sum of EUR 250 for changing the lock.
H. CLEANING
The accommodation is offered to the client in a clean state. During
your stay, you must clean up the garbage and deposit it in specific
garbage cans, which are placed at various points on the public
road.
Please do not leave any garbage behind, cleaning this up will mean
that additional costs will be charged to you.
Upon departure, you must leave the accommodation in a clean state
without leaving, for example, unwashed dishes.
I. ARRIVAL AND DEPARTURE TIMES
On the day of arrival you are welcome in the accommodation from
4 p.m. onwards and on the day of departure you must the accommodation
before 10 a.m., with a view to the survey, cleaning and laundry,
bed linen.
Where possible, the arrival and departure times will be flexible.
J. PETS
Most house owners do not allow pets.
Pets are only welcome with the explicit permission of the provider
of the accommodation and a statement on the booking confirmation.
Undesired pets, such as ants and/or other insects, are more frequent
in a warmer climate.
Insecticides often suffice to get rid of that problem.
Otherwise, please inform Viva la Villa, we will make every effort
to get rid of the unwanted visitors.
K. YOUR COMPLAINTS
We will make every effort to offer the accommodation in the best
possible state, if you have any complaints, please contact one
of our representatives or the Viva la Villa office in Jávea
as soon as possible.
We will then seek to solve the problem.
If Viva la Villa does not hear from you during your stay, we assume
that everything is in order.
L. JURISDICTION
Viva la Villa is an enterprise with its registered office in Spain
and a representation in the Netherlands.
As the occasion arises, Spanish law applies. |
